Should a shop sell ice cream that is runny?

İ have just been to my local coop which is about a 4 minute walk from my house. İ purchase 2 tubs of ice cream. İ walked sraught home. When i got home i opened both tubs to serve up for pudding and both ice creams were very soft and runny barely frozen at all. Should a shop sell ice cream like this, is it legal. İm guessing theres a problem with there freezer. İf i put the ice cream in my freezer and let it freeze will it be ok to eat or not. İ dont know how long the ice cream has been in the shop melted before i bought. İ would take it back to shop now but they are closed. İs it best that İ throw ice cream away Any advice would be much appreciated thanks in advance.
