Can we file sec9.HMA, in court simultaneously a complaint is in CAW?

my sis complaint case in CAW cell, where her husband denies for reunion. can we file HMA sec9 restitution of conjugal rights in court, as caw police officials are in process to file FIR against sis's husband and her inlaws. or if we fiel HMA SEC9, will CAW compalint would be null??
